Buying a site - when does the landowner get paid?

    Have agreed with a landowner to purchase a site from him subject to planning permission but what are the general guidelines with regards to him getting paid... do he normally get any sort of downpayment now and the rest when permission is granted, or do they all accept that they have to wait for permission to be granted to get their money?

    Bryan, I am sorry, didnt mean to break any charter rules, but I was only asking for some guidance, I thought it was a fair question, can you explain to me what rule I am breaking? And please explain what you mean by OP as I am not familiar with this term

    I think the OP is worried he might get gazumped if he hasn't paid a deposit . If another buyer comes along and is not worried about "subject to planning" the landowner might take the first cheque he gets.

    I read the original question as should he be giving the guy a deposit, how much and maybe with some stipulation that its fully refundable if planning is denied.

    Usually you pay a deposit to an auctioneer. Then the vendors solicitors will send your solicitors the contracts having done their work on the contracts they will advise you to sign the contracts and pay a contract deposit to the vendors solicitors. Obviously the conditions include you getting planning.

    You and the vendor are bound to the contract once it's signed.
