    I was just reading up on the new DC Rules, and I can't get my head around one bit if anyone could shed some light on it:

    For Hearings in Civil Proceedings under Order 49 re Setting Down for Trial it says:

    "4. (1) When an Appearance and Defence have been served and filed, the Claimant may serve Notice of Trial.

    (2) Not less than 10 days notice of trial must be given to the respondent and all other necessary parties, save that the parties may agree that a shorter notice period must apply.

    (3) Notice of trial must be filed with the Clerk promptly following service for each additional party."


    To me it seems that you would have to send a respondent in such a case a letter with an accompanying notice of trial and state that after 10 days you intend to set the matter down for trial with the DC Clerk and obtain a date for hearing.

    Meaning the next step is after 10 days of the above going to the DC Office with the above and other required docs to do such, obtaining a date and serving that on all parties?

    Or would you have to go to the DC Office first and get such filed and then serve?

    I know in the HC for Setting down Trial and giving Notice you have to have the Notice stamped before serving.
