Faulty phone

I bought a phone from mobileshop.eu (they're based in Slovakia) on the 8th of January this year. It arrived fast and I was delighted with it until the other day the phone locked up for the first time and then the phone microphone stopped working. People cant hear me when I'm making or reviving phone calls nor does the voice search or Internet calling work. I haven't dropped the phone, I have tried soft reseting the phone and gently cleaning out the microphone hole to no avail.

When I bought a phone they offered a warranty for extra and I didn't purchase it as I am meticulously careful with phones. The warranty certificate contained in the box say its "Applicable for products purchased in Malaysia only". I emailed the store explaining what happened and asked if they could assist me, they just said they could only help if I bought a warranty. I'm not very good with legal stuff but everything I read online seems to say if they as a member of the European union sold me faulty goods they should have to repair or replace it.

Am I right that they have to replace/repair it?

Thanks in advance for any help.
