    Hi all Iam looki ng for some advise as a dog ran into my car, the owner was present at the time and gave me her name number and address and said she knew a pannel beater that would fix my car and she would call around to me with details. After 3 weeks waiting and no call or contact I phoned her and she said she was still calling him but no answer so I got a quote for repair myself 480 euro. I text her with the quote and she replied she was not working and wouldn't have money to hand to pay for this and could we come to an agreement, I'm a fair guy so I said I'd see if I can get it done cheaper myself as I'm good with cars I am looking everywhere for second hand parts same colour but to no avail. I found a new part unpainted for 80 euro and am willing to pay for painting myself, I text her with price which she agreed to pay for but in two payments of 40 euro each week and would drop over first payment last week and second payment this week. Guess what nothing on her behalf so nowimI'm looking to just claim from her house insurance as she is playing games with me and my car is rusting for 4 months now. Can I claim from her insurance and does she have to provide me with this details if I request it Orr is it small claims court.
    Any advise would be appreciated as now I'll have to foot the bill myself

    Small claims court would not deal with this - District Court job.
    This should be dealt with by the liability cover within her contents insurance. I don't think she is obliged to disclose her insurance details to you.
    Have you reported this to your motor insurers? If not, do so.
    As you hit a dog on a public road I think that you need to report this to the Gardai. Check with your local station.

    I phoned insurance company they advised me about content insurance and her dog hit my car as I stopped and I was not moving at the time as I seen the dog running at me and he ran into the side of my car, the damage is to the wing of the car, the district courts would cost more than the repair so won't be going down that road. .

    You do not, only for personal injury. The dog's owner was there at the time and exchanged details with the driver of the car so there is no obligation to report it to the Gardai.

    The 1968 RTA amended the 1961 act to say that unless a Garda came to the scene, all accidents involving personal injury (other than the driver) had to be reported to the Gardai so simply exchanging details at the scene was not sufficient. Didn't include dogs.

    OP, you need to find out what kind of setup this woman has. By this, I mean that you need to check what kind of house/car she has, etc.

    Then you need to make a decision as to whether you want to sue this woman or not. If she has no money, then there may be no point in pursuing her.

    You say that the dog collided with your car. Is it possible that you were in any way negligent, yourself? If not, great. If you were at fault in some way, perhaps a court would find that there was contributory negligence on your part.
