Planning permission running out!!

    What needs to be done when extending planning??

    You need to speak with the planning section in your local authority first, explain your situation and take their advice...but...it will probably end up being an application for an extension of duration to the existing planning permission (which really is not an onerous aplication, pretty straight forward).

    I assume you submitted a commencement notice when you started work?

    If so, just bear in mind that the commencement notice also has a lifespan of 5 years (i.e. you must complete within 5 years of submission of the notice), but if you build/complete as you suggest, this should not be an issue.

    No. This building has commenced.

    There's no facility in SI9 for retrospective action.

    If it has commenced without a commencement notice then what are the options available to me??

    If he has to resubmit an application for extension of planning would a new commencement notice be needed if an original wasn't submitted.

    As docarch suggested.

    If the build is "substantially complete" which is generally considered at wall plate level, you can apply for permission to extend the duration of the original permission.
    You must get this application in before the original permission runs out.

    If substantially complete without a commencement notice when started at the time, will this affect my situation or is it as straight forward as you say. Thanks for everyones replies so far.

    Don't worry about the non submission of a commencement notice.
    You can try to submit the short form commencement notice when you get permission and restart construction.
    There's no guarantee it will be accepted, but it might be.

    From the point of view of an extension application, don't worry about the commencement notice.

    + 1 to this. Don't worry about the commencement notice...what's done is done, you cannot submit one now.

    Concentrate on getting your planning sorted/extending your planning permission.

    Just one other query...were there financial contributions levied as part of the original planning permission? I assum there were. Did you pay them when you started work on site?

    Hmmm...that really does not help! You have breached your original planning conditions.

    You really need to get the best professional advice you can to talk to the council on your behalf and try and sort out where you are at.
