    This guy doesn't get it.

    The point is that it sets a dangerous precedent.
    What if they emailed 100,000 people by mistake?
    Would that be a €10 million euro mistake?
    No. The amount of the fine was crazy excessive because she didn't suffer €100 in damages.

    They could have been liable for €5000 per offence.

    Be careful with your email big business is the message. Who is to say that being spammed isn't worth €100 in disturbance.

    They should try fining some of those nice Nigerian men who try to give you big money for looking after their accounts. I don't think they'd appeal ......... PR and all that :D

    That's why you get a warning the first time it happens. Make the same mistake again and you deserve to be fined.

    The judge should really have increased the €100 to deter others.
