Dole Dilemma!! Please Help!!

    Just posting this on behalf on my friend as I don't have the answer for her and someone here might know.

    2 years ago she was living alone in her apartment and her boyfriend's contract finished in work. he moved in with her so that he could get the dole (she was on it too) but she had to claim for him (does this make sense) because he said that he was living with her? Anyways he got his job back after a month and got off the dole and moved back in with his parents.

    They then moved in together into a lease, she was unemployed and began getting the dole even though he was living there. She said the social welfare inspector called her for an interview and asked her questions about her other half but she said he didnt live there as she needed her own money. He called to her house once to make sure she was living alone and was approved.

    She got casual employment in a shop but only a day or so here and there so was on the JSA- the X and O thing (havent a clue what this is) and they moved to a new address- a house that was gifted to her by her parents. She has since had a baby for her boyfriend too. All of the bills are in her name and he pays for the weekly shopping, thats about it but still lives in the house. She was able to get work for a few months at the beginning of this year in that same shop 4 days a week but SW told her she had to close claim due to her hours which was grand. Beginning of Jan, her child minder (her unemployed brother) tells her that a fella calls to the door asking for her and that the man said he was the SW inspector. he asked was her brother living there but he said no, that he was the inspector. SWI asked if his name was Keith (friends boyf) and he said no.

    She had signed off since getting the job but doesnt know why the above happened.

    Her question is, her hours are coming to an end in June as shop has decided to close down. Even though she is not married to her boyf but he is still living in her house, can she go back on the dole, without getting hassled by the SWI? She's not even sure why he called out to her twice in the space of a year (to two addresses).

    Is she actually able to claim JSA or Dole?? Regardless of if her boyf was in the house, can she still claim because she is not getting any money from him?

    To be honest, they are completely independent of each other, they have been together 4 years and she has never so much asked him for a penny even to put towards the child, just as long as he gives money towards food bill.

    Shes just a bit wary of signing on again as she feels she is marked now and that as soon as she does the SWI will be out again.

    Any advice out there for her? She is freaking out about not having her own money again once she loses her job. She has literally being trying to progress herself as much as she can doing online courses and evening classes so she can get employment. She is quite qualified regardless of this but is clueless (as am I- never been on SW so not sure how this works) as to what is going on?

    Any advice is greatly appreciated!

    She will be assessed as cohabiting.

    She may be entitled to JSB, if so, his wages will not matter. (this will last for 9 months)

    If she is not entitled to JSB, then she will apply for JSA and his wages will be assessed as her means, whether she receives anything or not.

    If he is earning more than €500 per week, there may be no payment at all.

    If he is earning less than €340, she may get €188, as long as she is over 26.

    she's just beside me now, shes 27 in september. he earns about €600 a week and that's why she has been trying to claim as independent as possible (although they live together for the sake of the child). She just doesnt understand why the SWI has called out to her twice.

    Her main question seems to be, could she just go on claiming her JSA and say that he is not living there?

    She just wants him ruled out of the equation altogether so she can be independent.

    I think really this stems back to when he first claimed the dole- maybe he should have said nothing about her.

    She just really wants a way around this while she is job hunting so that she has an income to pay her loans and bills. Literally after it all she has €50 to her name a month and it all goes on the baby. Even if it is just for the summer.

    If she tells the DSP that he not living there when he is that is fraud and is a serious matter. Telling the truth is always the best option.

    So he lives in her house for free and pays nothing towards his child or utilities even though he's earning €600 a euro week.With €50 after all bills are paid whats the father do with his €600. They essentially want SW to treat them with an extra 250 euro a week through fraud. I get amazed at some of the "dilemmas" people post online:rolleyes:(sounds awfully trollish with 2/4 year timeline)

    TIP: Tell her to ask for some rent and maintenance for their child/utilities of the BF and she can treat it has her own money if it makes her feel any better because any illegally claimed welfare certainly isn't hers.

    If I read the circumstances of this girl's situation correct, she should have been means tested much, much earlier and may now owe significant arrears.

    If I were you, I would strongly advise a voluntary disclosure to the Department. At it's basics, it will at least remove the question mark. You can never overdisclose here. Overdiscloser is the key. Lay it all on the table. Though I suspect a hefty bill will be in order.

    The situation is this, and plainly this:
    On the departments handbook, she is cohabiting now. And she has been cohabiting to date.
    I see what you are trying to do on this and would say that it is only natural, rational and prudent that a person would try arrange your affairs in such a manner - maximise your money, or for some people to just basically allow them to get by. It is even moreso rational and human nature when you've a baby with a hungry belly.

    But she is cohabiting. It is substance of the relationship, rather than the form you try to present it in.

    This story wouldn't be an analogy for you(the OP) who's a teacher who is living with another teacher(bf) who has a permanent job and have a child together, wondering can you claim benefits while he's working . It would look awful for a teacher to be in court for defrauding SW:eek:

    post history tells an awful lot, It's definitely you, replace shop with school and we have a winner. When do teachers stop working, the summer.
