eBay dispute - "by the 16th March"

Bought something and it never arrived. Seller is no longer registered and the auction was pulled. I opened a dispute last week and it's saying the seller has until the 16th March to respond.

I'm a little annoyed that I have to wait even though it's clearly a fraudulent auction. It was a Buy It Now and there were 29 other buyers.

My question is a bit silly: does "by March 16" mean that tonight at midnight I can escalate or do I have to wait until midnight tomorrow? It's agony waiting to find out whether I'll get my money back or not.

Never mind. I got an email at midnight asking if I wanted to escalate the claim. Literally two minutes later I got an email ruling in my favour. Due to the exchange rate I think I made a fiver too! :)
