Court case question!

Hey,

Just wondering if anyone can help me out here...basically a 2 months ago my boyfriend was in a taxi with his mate who is a girl. He said a joke to the taxi driver and the taxi driver went mad and went to hit his friend, so my boy friend then told the taxi driver to get out and went to hit him in defence of his friend, he is now getting done for it , but has no previous assault convictions, however he has penal warrants for fines he didn't pay. Traffic offences and one for cultivation of plants he was growing for personal use. ( No he is not a dealer.) Also his friend was killed last year and this was the day of the inquest. He was attacked by the people who killed his friend before so in that area he carrys a bat for protection. Has never used and it was not used that day either. His friend was holding it for him while he hit the taxi man as it was in his jacket. The friend got caught with it in her posession so she is getting done for this but it was his and he will say that so who gets charged? The bat was not used at all in this incident nor was the taxi man at all injured!!
Just wondering what happens in a case like this and also will it come out about the penal warrants..will he have to default on them? I heard that if you have fines you only get kept like a day? The only reason he has not paid yet is because he does not have a steady job at the moment!
I am really worried, if anyone cud help that be great!

It will be up to the courts to decide on this.

A few things that I would highlight:

Why would the taxi driver attack a passenger due to a joke told by another passenger?

You say that your friend asked the taxi driver out for a fight - in defence? Does not make sense. Sounds like rather than defending it was to further aggravate the situation.

Carrying a bat? in a taxi? .... sound like a nice chappy.

History of drug cultivation, other misdemeanours and failing to pay fines ..

A solicitor would be the only person who could give any idea how this might pan out and how to structure a defence.

Boyfriend's story sounds like a load of rubbish tbh.

Tell boyfriend to go to a solicitor if he gets charged.

Right...the taxi driver went to hit a girl because of a joke? At which point your friend asked him to step out of the taxi so he could hit him. In defense? And he was also carrying a bat. Was it produced? Either way doesn't sound good at all.

Any previous convictions will be taken into account if/when convicted and the Judge is sentencing. They can't be brought up before that in court.

The outcome will depend what he is charged with. Speak to a solicitor for legal advice.

Ok thanks! Yeah I no like it sounds terrible but basically he is not the same person any more, all the other stuff for getting in trouble was years ago when he was younger , we all make mistakes like! I don't know why the taxi driver went to hit the girl either..its mad!! But my boyfriend wouldn't lie about it and he is not one to start trouble or fights. He told your man to get out because he was pissed off that the taxi driver had went to hit the girl so thats why he went to hit him. Not good either at all I know!!! But these things happen!!!
No the bat wasn't produced. He didn't have it with him to hit someone, was only carrying it around that area because its a really, really rough estate and he was attacked there before and left in a bad way. I know it sounds like hes a scumbag but hes honestly not. Not asking this to get free advice for him, he doesn't know I'm asking. I just need to know for my own piece of mind because I am worried sick but yeah I am sure there is some free legal place I could ask for more info. Thanks.

Was he in the taxi or just walking around?

He was in the taxi. He brought his friend up to the shop because it is a bad area and he didn want her going alone and then they were getting a taxi back . He was jokin with ur man, maybe ur man took it up wrong, who knows..but he flipped and went to hit the girl and got her on the nose so that is why my boyfriend did what he did. I know there is no excuse and he shudn have aggrevated but guess he was just pissed off, no one likes to see a girl get hit.

Yeah honestly, he isn a liar, he would tell me. I know how it looks but honestly he wud tell me. Besides he is not one who goes out lookin for fights. He wud never hit a randomer just like that

So your current boyfriend did, at some point in the past, though not then boyfriend? toddled off to the local shop, armed with his bat, for protection like, to accompany a girl there.
Your current boyfriend and girl, having proceeded with shop transactions, decided to get a taxi home?
Your boyfriend made a joke, the taxi driver didn't get the joke, the taxi driver then went to hit the girl. At this point, your current boyfriend asked the taxi driver to step out of the car. At this point, he produced the baseball bat.

Is the above version of events correct according to your boyfriend?
