P21 says I owe Revenue

    Hello

    Appreciate any help here. After 9 years working for a computer company in Limerick - I was made redundant in January last year. I took the decision to move back to Wales permanently where myself and family are from originally. I understood by leaving the UK after only 21 days in the tax year that I could claim tax refund based on residency.

    I subsequently got refunds on by redundancy and other taxable earnings from Revenue for January. I also thought I would get top slicing relief too at end of Irish tax year (2013). When questioned this I was informed my tax was being reviewed. A few weeks later I was asked to submit evidence of UK earnings etc which I submitted to revenue. However I recently received a P21 which now is suggesting I owe them EU500 for USC. Further analysis see that some double taxation calculations were made but I was also charged USC on all my earnings in the UK.

    Is this right as I was only in Ireland for 21 days in that tax year (so 2 year rule should not apply). Secondly I have been paying UK taxes and other charges on my salary in the UK. (note tax year in UK is April to April yet revenue ireland are looking at all pay Jan - Dec)

    I have sent letter of appeal today - based on the residency test (as i understand it) and also that throughout the year I questioned how refunds were being calculated and was not made aware of any requirement to consider tax / usc on uk earnings.

    If they take USC on UK earnings does that mean I should be able to claim child allowance from Ireland for the year?? I dont think so!!

    Appreciate any advice please.
