LMO and partner

    My partner has just accepted a job and the company are in the process of applying for LMO. We are finding mixed messages online as to whether or not I will be eligible to go with him, we also have a 4year old son. We are both going to go as his dependants.
    We live together with my parents have done for the past 3years, we have no utility bills in our names as we pay rent directly to my parents which includes utilities.
    Is it going to be difficult to prove the validity of our relationship?
    Has anybody any past experience with this? Would it be easier for me to apply for an IEC visa for myself and let him go ahead with LMO?

    Any advice would be appreciated. Thanks

    Hi,
    I posted about this recently and got no real replies but have done a bit of digging.From what I can see you will both be eligible to go with him but you may not be eligible to work.On an LMO in order to promote family life Canada allow you to enter with a visa for the same length of time as your partner.Is he listed as the child's father on the birth cert and if so are you both down as having the same address?.I believe this is a good start to proving common law status.Also ensure when your partner is applying for his visa he fills in a separate form available regarding being in a common law relationship.He may have to get this signed by a solicitor but hey it's worth having.I have an IEC visa valid for entry until end of March and am heading over for a weekend to activate it incase I want to work when me and baba move over.Himself is already there a few weeks at this stage.

    Whats you partner do?
    You can get an open permit if he is in a skilled category.

    IMM5409E.pdf is the form he will to fill out and get witnessed I believe
