Could RSA have prevented my accident?

    Hi Boards members....is my first time on this blog and i'm very excited about people ideas and issues...Now is my turn...I month ago I had a very serious road accident due to some black icy road that was around 5.30 am. My car over turnes three Times and entered 7ft downin a dich miraculously I came out alive i was very aware of the weather condtion.lon the road and driving between 60 to 70 kph...the was writeoff..
    .My question is do you think RSA in our local area should have done better to prevent such road accident by salting the road before at the time of accident

    Is this question asking were the RSA at fault or liable for causing the accident you were involved in?

    As far as I know salting roads comes under the local authority's remit.

    To me, 70kph sounds a lot on any roads that may have ice/black ice, with the exception of a decent straight N road.

    In any case it's up to your local council to grit the road, not the RSA.

    Aware the roads were apparently lethal but still doing 60-70km hour which in turn caused your car to turn three times, def sounds like you weren't driving in a style suitable for the road conditions to be fair,

    Not sure just how bad the roads could have been when you had your accident, there's been very little frost and snow this year. Certainly next to nothing compared to say 2010.

    I managed to skid my car once during 2010 yet I drove 60+ miles a day most of which was on ungritted back country roads,

    Without knowing the road and the weather conditions on the night in question Id say its nearly impossible to answer this unfortunately. Black ice can occur in conditions that can catch people unawares, and with the best will in the world its not always possible to salt/grit every road in the county.

    Even where roads have been gritted/salted you have a duty of care to drive the conditions, so if you feel that temperatures are low then you should be driving at a suitable speed, regardless of whether or not the road has been salted. It sounds like a scary accident, and Im very glad to hear that you walked away from it, but I dont think you would have much joy in trying to find the council liable.

    It think the OP may have confused the RSA for the NRA who are responsible for National Primary and Secondary routes in conjunction with Local Authorities.

    The topic of salting in covered on their website at http://www.nra.ie/network-monitoring-and-management/road-maintenance/ and one very specific statement stands out:
    The NRA is constantly striving to improve the winter maintenance service. However the NRA and local authorities have no statutory obligation to salt roads.

    Based on that I don't think you can hold any authorities liable for something they are not required to do. And anyway, how do you know the road wasn't salted much earlier in the evening and simply refroze by the time you got on it.

    I don't believe the combined forces of the AA, NRA, RSA, LA or any other road safety or motoring organisations could have prevented your accident as described above. There are certain conditions no-one can legislate for.

    The RSA don't grit or salt roads. Its up to the local council and maybe the NRA on motorways?? but defo not the RSA.

    Either way you cant grit every inch of road in the country every time there is frost. You need to take some personal responsibility IMO. Learn and move on.

    noone but the almighty (whoever she is) is responsible for icy roads. For the Authorities to be liable, you would need to show they didn't salt the road properly rather than didn't salt them at all. I doubt you can do that as the evidence all disappeared when the temperature rose.

    You be better of blaming the RSA for allowing you have a license than salting the roads.

    These things happen just be grateful no one is hurt and you lived to tell the tail
