death in a nursing home

    Hi Im wondering can anybody help.
    An distant family member who has been in a nursing home for 10 years has passed away. He was on a pension and part of this went to the home. Im just wondering who is financially responsible for the burial? Any help would be appreciated

    Burial where the deceased has no means

    If someone dies without the means to pay for burial and if this person has no traceable next of kin, it is the responsibility of the Department of Social Protection or local authority to ensure that the person is buried in a dignified manner that does not impinge on public health or public decency. The Department or local authority will also be liable for the charges and costs involved in doing so.

    If the family want a certain standard of funeral, then they will have to pay for it.

    Undertakers understand that it may be some time before they are paid. However, they will sometimes offer a discount for prompt payment.

    Burial is a charge on the estate of the deceased. Whoever administers the estate has the responsibility to arrange burial, and to pay for it out of the assets of the estate.

    If the estate is not large enough to pay for funeral and burial costs, family members may contribute in order to finance what they regard as a proper funeral. But they are under no obligation to do so.

    If there is no money in the estate, and if family or relatives do not choose to cover the costs, then the state will step in, as outlines by ken. The burial they provide will be fairly basic, but respectful. In theory they may seek to recover the costs from the estate, if they thenk there is some money there, but I believe that in practice this rarely happens.
