Mistake by court?

    I got a letter which states I was driving without insurance and I have to go to court to answer this accusation.
    The thing is, that I was insured (can proof it of course) and even had the disk in the car.
    So can there be an mistake by a guard who accused me?(i was pulled over, but all was sorted).
    Will a wait for the court date or go to the guards station to correct this?

    Were you asked to produce your licence or any other documents to a Garda station when you were pulled over?

    yes, and I did it, and the Guard said it was all fine (to be honest, he looked confused, not sure if he entered my name and all in the system)

    What they never told you was you also needed to bring details of insurance.

    You were never told at the time to produce them and in the Garda station it was never mentioned?

    Same thing happened to me a few years ago. You need to contact the Garda whose name is on the summons and present your insurance cert for the period in question.

    I went to court with a solicitor and all the docs as I was young and bricking it.

    The Garda read through them in the courthouse that morning, said that was fine. Case was called, Garda said it was dropped or something to that effect - next case please.

    It's very annoying how they do this to people. If they want docs, just say it.

    A few years ago I was asked to produce insurance documents. I did so but it was never recorded correctly on Pulse, with the end result being that I had a summons issued for driving without insurance. In my case, I contacted the station, met up with the relevant garda with the correct documentation who duly had the charge struck out. If I were you, I'd make contact with the garda in question and ensure that they have this proof as a matter of urgency.

    I actually had to bring in the tax disc (that was why i was pulled over). And NCT, but NCT was booked in for a few days after I was pulled over, so that was fine.
    and insurance disc was in the car anyway. The guard was very nice (and I a wreck cause I just lost my job ha), so i got a good fright now!

    Oh I was, and I did produce it. But when I showed up the guy at the station seemed like he couldnt find my details, i gave him all 3 discs!


    How do I contact him, do I just go the the Garda station?
    Or simply go to the court day?
    Even though im accused of driving an un-insured vehicle at the time, i should still be fine cause i can proof that this was NOT the case?

    His name should be on the summons. Just phone your local station or even better just call in.

    Just FYI, the windscreen disk is not proof of insurance. The cert is proof.

    Why do people need a disk in the first place (in the car?) Didnt know that, but had the cert with me within the 10 days.

    So it can be checked at a glance whether you are insured or not.

    If it looks anyway dodgy you can be asked to produce your insurance cert.

    Okay, good to know.
    there was nothing like that, because I was pulled over for tax in the first place, so quiet suprised about the insurance part :)

    when you are pulled over by the guards for anything, it is pretty standard practice for them to request that you provide proof of all required paperwork (license, paperwork, tax, NCT, Insurance -not disc) at a station of your choice within 10 days.

    I can't seem to make out from your posts if you actually produced your Insurance Policy (not disc) at the station? If you didn't the summons would still be valid as you didn't produce as directed by the guard on the road.

    I would be hopeful that should you bring evidence to the court that you were insured at the time of the stop and that you in error only produced the disc at the station that you won't end up getting prosecuted.

    It would still be worth having a chat with the guard.

    I actually had the cert with me at the station!
    just to be sure i brought everything, even the NCT shed!
    I willl defo give him a call!
