Confidentiality Agreement

    Hi there,

    I am submitting a patent today in the UK for an idea that I have.

    I will then be pitching the idea to a particular company in the following weeks. I need advice on how to create a confidentiality agreement.

    Do I have to go to a solicitor to do this? Or can I create one myself? If so, what does it need to contain?

    This is pretty urgent so if anyone could respond asap, i'd really really appreciate it. Thanks.

    Just FYI, in the context of what I believe you're proposing, creating an effective "confidentiality agreement" is going to be very difficult. It is unfortunately the case that making proposals to businesses can lead to the idea being either totally ripped off or adapted so as not to infringe on the patent. Be careful how much you disclose.

    What you need is a a Non Disclosure Agreement. Usually these will acknowledge what each party brings to the table.

    Are you filing a patent without a lawyer?

    Do you think the company won't have a lawyer to look at your pitch?

    You don't have to go to a solicitor, in the same sense that you don't have to go to a dentist to get a tooth extracted, you can do it yourself with a bottle of whiskey and pliers.
