I have recently sought medical help for mental health reasons, the doctor believes me to be heavily depressed and he is referring me onto psychiatric help and he also gave me a medical note for some time off work. Upon presenting the medical note to my boss, my boss then told me the medical note was unacceptable and I would have to stay working and when he deems it ok I can have a week off. I of course told him I wouldn't have been given a medical note if I was OK to work. And then, he tried to blackmail me (I think). About 6 months ago, a member of staff accused me of selling drugs from a local shop, I wen't along with this and they dismissed it as management knew I wasn't. So, my boss brought this up because after the accusations I quit in anger, but was offered my job back just a few days after, but my boss brought this up and said '' I didn't have to re-hire you then, I did it as a favour. So you owe me a favour and you have to stay working.''. What do I do in this situation? I have a copy of the medical note with an official second signature from my doctor. Noone else witnessed him saying this to me,but I can't allow this to pass me by.. Can I get in touch with a lawyer? Will it just be his word against mine?

First stop - Human Resources department. Your doctor has prescribed time off work, your boss is being negligent in trying to manipulate you into not taking it.

I work in a small shop, we have no union rep nor human resource dept.

I'm pretty sure there are insurance implications if you work on sick leave, the employer isn't covered if anything happens

record his reaction on paper, take your prescribed leave, and if he starts on again get legal advice

If you are signed off as medically unfit to work, your workplace's insurance doesn't cover you to work, so he cannot make you work. Go straight to hr

There's a busy work and jobs forum where maybe you might get quite specific, action based advice so you could try there too maybe?

Hope you get it sorted soon and that you're feeling well again shortly. Your health is everything so make sure to put that first.

If you hand in a medical cert from your GP stating that you are sick then your boss can do nothing about it, he is trying to pull a fast one
