Commencement Notice for Development query

    If a form of commencement notice for development is submitted prior to March 1st can it be filled in with general details once PP has been granted (ie: builder would be owner, all contact details would be owner etc)

    What additional information would be required?

    Have you got your Final Grant of Planning Permission or your Notification of Decision to Grant Planning Permission ?

    You need all your builders details, site contacts, foundation inspection person etc
    its an offence to milead the BCA with incorrect details on the CN form, but i dont know anybody that has beed prosecuted over it.

    In DCC, it kick starts the procedure for contributions, levies and bonds.

    what is the status of a garage say over 40 sqm. Will it come under the new regulations if a commencement notice is lodged after March 1st ?

    I can't see new garages being Considered "extensions" under these regs.

    Now that I look back at the post I think you may be correct. I kinda thought it was an extension to the existing house but if the planning application is specifically worded as a garage and used for the sole purposes of a garage (ancillary to the main dwelling) then yes, it may come under the old regs and only require a standard CN.

    But I would also hope that the PP would be conditioned to de-exempt the exemptions then to stop people gaining PP for garages and then promptly converting them to residential use immediately.

    Sorry for the confusion.

    The new building control regulations apply to:

    (a) the design and construction of a new dwelling,
    (b) an extension to a dwelling involving a total floor area greater than 40 square metres,
    (c) works to which Part III applies (basically any works that require a fire safety certificate).

    So new regs would not apply to a (domestic) Garage over 40.0 m.sq....if the Garage was for commercial use, a fire safety certificate would be required and therefore new regs would apply.
