    Lived in Kildare for many years but was away from Farming at the time. Had to say I felt jealous of all the new Green Tractors etc parked outside North Kildare Dealer parkedup and ready to go. Anyway,Im further south now and doing a bit of farming again. We needed a handy SH 2000gal Vac tank to go behind a "Big Dog" of a Zetor 12441 we use for loader work. Self same dealer sold us a 08 Belmac 2100 and at 5900 delivered , the tank was 2/3 of the new price (notwitstanding that the new Belmac would have 28 LGP tyres as opposed to the 24s on the 08) Anyway tank arrived in yard with no oil in gearbox, neither filler lollipop greased , one strained and the other missing a bit of the handle. In addition, the Ball jar was caked in sh1t and blocked up. Four brothers potter about the home farm so a few DIY fixes promptly followed. Worse was to come when the tank got its first 1/2 day's work today. Pump oil had been "milky" on delivery, so we put Milking machine oil in dropper tank instead. After the morning's work the oil had turned creamy and pump slowed down On load 8 the whole thing stopped. Pump was not working at all. On ringing the Rep who sold the machine I was given a series of DIY tests and then a few DIY repairs. No offer of "We'll send a man out to sort it as we did give you a six month warranty". In fact it was suggested that I had set the oil dropper too slow(very hard to get oil contaminated with water to drop@20 per minute!!!) On thinking , it appears that the Ball in the pump pipe is distorted or leaking and thus the dropper oil is being contaminated with this water. Also the newly filled gear oil is already contaminated with crud(IMO seals in gearbox have a few leaks allowing crud back from pump)
    My questions are
    1.Should a 6 yr old machine @66% of new price be "fit for purpose".
    2.Can a Garage hold you responsible for a consequential loss resulting from a machine being sent out inadequately serviced.
    and
    3. Does the "Three Strikes" you're out rule of the motor industry apply to Agri sales. If they fail to repair it twicw should I get a refund.

    I specified that the back filler be replaced and Servicing of pump arranged. Also a Six Month warranty thrown into deal to bring it up to Summer spread. ie. 200,000 Gals.

    Have you paid them?
    If by cheque and at delivery stop cheque till issues are sorted.

    As for consumer rights you have none. Farmers and self employed are not in the consumer charter. I found this out the hard way with a new machine I bought that wasn't fit for purpose.

    I did manage to get the warranty extended by 12 mts with the manufacturer, after threatening to place a placard on their stand at the ploughing. May i add that this threat came after months of being fobbed off!! As soon as warranty expired I traded the machine.

    Have had the same experience from a manchinery manufacturer up north who will remain nameless, bought a demo model from them that hasn't worked as was supposed and constantly fobbed off by them. Was going to see them at the ploughing but reckoned i might not be able to control my temper if it got out of hand.

    Update. I've issued a "Snag List " to company which their fitter will hopefully sort out this Tuesday. They appear to have had an issue with some "Gasson" who was supposed to check over tank before delivery. Very impressed with their attitude and will post an update midweek.

    Just be careful saying anything too harsh about a named company here. I know you prob venting but if wrong person say this, you might be told to p**s off very quick.

    Fitter arrived midweek. All issues seem resolved. I'd say some monkey got his "Nuts Roasted" given that they had to put a man on the road for three hours to repair a machine which left their yard with a approx €40 of parts to be fitted. ie. 1 hour + parts became four hours + parts as well as a a man on the phone for another 40 mins to me who could have been selling etc. in that time. ImprEssed with service nonetheless.

    Glad you got sorted. You always feel coddled when something goes wrong with a new investment. All u want now is a bit of good weather.
