Lost Overtime

    Hi all,

    I have been working an early shift in work for the past 5 years, the early shift enables me to gain two overtime hours per day.
    My employer now wants to change shift patterns which will basically mean i lose the "early hours" bonus.
    My contract basically sets out that they can do anything re shift patterns but just wondering if the length of time that i have been doing these shifts can be argued as customs and practice as i have built up that pattern and the consequent wage i will earn?

    Generally no however union involvement can get this done. The "customs and practice" argument isn't really a legal one but one unions use when dealing with employers.

    In this case I would say it would be difficult. You were paid an amount to do overtime/out of hours work. If you are no longer doing that then why would a company expect to pay this premium.

    I do see it from your point of view I just don't see as reasonable if you aren't doing the hours. Unless you are saying you still do the hours they just changed what they class as out of hours?
