Vijay will get his day in Court. Should the PGA Tour be worried?

    In a 27-page decision in Singh vs. PGA Tour, Bransten dismissed five of seven causes of action: three alleging negligence by the PGA Tour, one on breach of fiduciary duty and one regarding intentional infliction of emotional distress.

    But in the same decision, Bransten ruled against the Tour in the remaining two causes of action: breach of implied covenant of good faith and fair dealing as well as conversion.

    Easy to see the origins of the PGA Tour was started by a bunch of Lawyers from reading this. It is no wonder arbitration is a preferred option as usually such proceedings are confidential and not made available to the public.
    The court pointed out that the renewal form releasing the PGA Tour from any and all claims, demands, damages and causes of action whatsoever, in law or equity, and also provides for arbitration and the waiver of judicial review in cases of dispute, did not provide a basis for dismissing those causes of action.

    Vijay's lawyer has made some interesting comments also....

    “I can stand here in court today and provide the court with four or five or six or seven other names of similarly situated golfers who the (Tour) treated differently,” argued Singh’s attorney Peter Ginsberg. “Because there are other golfers, the (Tour) knows there are others golfers, and it’s simply disingenuous to say that we haven’t made our allegations specific enough."

    Wouldn't you just love if he did name names !! It'll never happen of course, but lots of injury absences might just be explained ;)

    Exactly. For Vijay's lawyers to show a breach of fair dealing, surely they must provide any evidence they have of other players using illegal substances and because it is in public Courts now, everyone would know about it :D

    This is very serious indeed, glad to see Vijay isn't going to take it lying down and will potentially expose the tours strongest asset. I suspect it won't come to that and the tour will do everything in it's power to keep it under wraps, although at the moment they are doing a very poor job at that.
