National reserve or Scottish derogation

    Hi,

    Young trained farmer here active in 2013 and for many years before. Have a disadvantaged payment but no entitlements (which I think was a bit of an injustice but that's another story)

    Been reading the journal and seen someone in a similar situation ( possibly not young trained) advised not to buy entitlements as they would get them under Scottish derogation if they hadn't bought/ held any previously....so it seems to me that I could possibly get entitlements through either this route or by applying to the new national reserve when opened up. Question is which should I go for, would one route yield higher value entitlements? Would one have a higher chance of success? Would applying for one preclude you from the other? Could you get entitlements from both sources? - were talking low enough value here (rising to 149 in final year under Scottish derogation according to FJ)

    I wonder if anyone could help me with this or maybe point me in the direction of what the various terms and conditions, payment rate would be if applying for entitlements under either of these categories/headings?

    i have land rented with no entitlements, im a young farmer too so not sure whether to apply or buy entitlements

    Same here and I believe you won't get entitlements from national reserve IF you have entitlements on your own land.
    I believe national reserve will be for young trained farmers with NO entitlements.

    Also, if you were to buy entitlements for the rented land and for some reason lost the land in a few years what would happen the entitlements you bought ?

    hi all
    in the same situation only started farming in 2013 young & trained, no entitlements. From what i have read if you want to qualify for a Scottish derogation, you must not have held or leased entitlements for 2013 or 2014. I have spoken to a couple of advisers off the record and tried to get a clear answer off the department on the situation without any luck, no one seams to be willing to give a straight answer or they don't know.

    Amacca, the Scottish Derogation would be possible however you will fair out better under the national reserve, you will also get greening and the young farmers top up for three years.

    Also Sami23 a person who holds entitlements can still get an allocation from the national reserve once the entitlements held do not exceed the national reserve national average.

    I have never held any entitlements and am farming since 2007.
    How, where or when can I apply for these entitlements. The Dept have indicated that I will qualify.

    You will be able to apply for Scottish derogation in September. It will be an online application.
