Question about a court fine.

    Hi folks,

    So today I was in court and the verdict was that if I paid 200 euro I would be struck out. Since I didn't have the cash on me at the time to pay it on the spot they gave me 30 days to pay the fine. After I finished in the court room I met up with a friend who offered me the money till payday.

    Grand I thought, so I walked back to the courts and paid the poorbox fine in the office there.

    Now I am just wondering, since the judge told me to come back on another date for to show a recipt, do I really have to?
    Like I paid the fine an hour after court, so do I really have to take another day off work to show proof that I have paid a fine. Would it not be on their system?

    Any help here would be appreciated(New job so I don't wanna be seen to be taking days off before 6months is over)

    The office should put the record of payment on the file but I would contact the Clerks office in the next few days to make sure that this was done. If the Clerk has it, then he will prob arrange to remove it from the list BUT do not take this for granted. Check and double check. Depending on the court and clerk, you may have to turn up. Don't forget about it.

    A court clerk cannot remove anything from a court list. Your case has been adjourned to a future date, for you to produce a receipt, by the judge. On that date your case will be called and at that point the judge will make another order, presumably striking out the charge or granting you a DPOA1(1) on production of the receipt. Did the judge excuse you on the adjourned date ?

    They wanted me to pay it on the spot but I honestly didn't have the money untill I met someone half hour later. I paid it then.

    Yes the judge gave me another date to come back and produce this reciept but it's more so taking the day off work(losing money) to prove I have already spent money.

    Maybe you might get some solicitor to do this for €50 or so if they are in court anyway. Try asking a local district court practitioner about it. Should be cheaper than taking a half day off work.

    Why don't you ring the Court office and ask them if you can produce the receipt in the office on a day that suits you?

    Realistically you have three options.
    1.Turn up and show the receipt as directed by the judge.
    2. Hire a solicitor to do it for you on the day (some judges MAY refuse this as you aren't present as directed)
    3.don't turn up

    If you don't turn up its extremely likely that the judge will deem you in breach of his direction to attend and assume you haven't paid the contribution. You will then be treated as such and receive a conviction in most cases.

    Essentially the judge made an order if you don't comply with it fully you run the risk. If it's a road traffic offence it's a fine/possible points. Public order/theft usually a fine and criminal record.
