Faulty boots from Northern Ireland

    I bought some Hunter Wellies from a shop, in the North, via ebay.

    They perished after 4 months & I returned them to the supplier. The supplier is saying that the manufacturer consider this to be fair wear & tear.

    Does the fact that the seller is in the North affect my consumer rights in seeking a full refund?

    You can only get repair/replacement/refund if there is a verifiable manufacturing fault.

    E.g.
    If you've been wearing these on building sites - then you wouldn;t have comeback as they are not designed for that.

    If you've been wearing them for normal outdoor pursuits, then possibly you have comeback, but it really depends on what you call "perished" and whether you wore them every day or just once a week.

    I disagree unless NI law is different to UK law. The seller acknowledged that they had perished which is a process where the rubber breaks down.

    By admitting this & not being able to show any damage due to improper use, the seller is confirming that the boots were faulty.

    I can't imagine that any Judge wouldn't expect a quality boot to only last 4 months.

    My question was whether there would be any problem because the boots were supplied in the North but delivered to the Republic.

    Rubber boots perishing within 4 months should not happen under normal domestic conditions.

    I suggest you contact the European Consumer Centre for advice on which jurisdiction has effect in you situation.
