holiday pay ..... finished up in work

    My former employers deducted holiday pay from my final pay packet.

    Their holiday year runs from 1 April each year. I finished work with them on 17 January 2014 & at the time of finishing I had used my full leave entitlement of 20 days.

    Are they legally allowed to do this? I had heard that once a certain amount of time had passed, they couldn't claw back the holiday pay.

    You might advise?

    You had an entitlement of 20 days per year and you used that full entitlement before you gave them the equivalent years employment. Yes they are totally entitled to deduct the days you took off that are in surplus to your entitlement up to your final day.

    It is probably listed in your contract of employment. I've seen it in every one that I have had. If you leave within the typical company holiday year they will recover any monies paid to you over your entitlement amount.
