File a claim or pay the damage

    I had an accident yesterday.

    But my car was unscathed. The other car also had a few scratch marks (driver side) and nothing more.

    The other driver was pretty shaken and wanted to call Guards. I did not have any issue with that but due to limitations I could not travel to the Garda station.
    We exchanged details for the insurance purposes.

    But later I got a call from Garda Station letting me know that I need to come and show my insurance and driver details as the other driver had filed a complaint.

    Today I got a call from the other party willing to settle if I pay for the damages which I agreed in principle (provided costs are less than my excess).

    I have comprehensive insurance with 6 yrs no claims and 2-yr stepback in case of a claim.

    But now I have few questions
    1> Do I settle if the costs are low ?
    2> Can I hold off calling my insurance company or is there an requirement to contact them asap (the policy document does not specify that I need to contact them immediately in case of an accident) ?
    2> What if the other party uses the garda complaint to goto courts/make a claim later ?

    Who was at fault?

    For me, personally, I'd consult the other driver and get them to get an estimate of the cost (i.e. Receipt from a garage) If its worth your while to avoid a claim, pay it and draw up a simple contract between yourselves i.e. What work was paid for and the person is happy to not continue with a formal claim and everything is now settled. The fact they rang you to do this is a fairly good sign.

    If your not comfortable doing that or feel the other person could take you for a spin, let them have your insurance details and go the formal route. Its what insurance is for after all.

    If you are admitting liability then I would contact your insurer either way. Even if you settle it yourselves, there is nothing to stop them (legitimately or otherwise) trying to claim injury or something down the line, and your insurers might not be too impressed to be hearing about a claim several weeks or even months after the incident happened.

    Thanks guys for all the feedback.

    I raised a claim with my insurer. Even though I do not have any damage, the other party has damage claims and I think the insurance company is best suited to handle that. Also with 6 yrs no claims, I hope it will not dent my premium much.
