Eircom's written cancellation policy?

If you need to cancel an eircom account they require you give 30 days notice but they also require that you give that notice in writing but will not accept an email and require you to send a physical letter.

My question is, can a utility company like eircom refuse to take 30 days notice over the phone or via email and insist on a written letter?

yes. Eircom are legally entitled to ask you to send in the 30 days day notice in writing. its cleary stated in their terms and conditions which you the customer are bounded by and which you agree to at the point of sale. I had this problem before, but unfortunately its a requirement

Is there not a determination by Comreg that Eircom are not entitled to insist on the 30 days notice if you are porting to another provider???

This was discussed in the Broadband Forum a while ago
For anyone that's interested Comreg have now issued Eircom with a ruling on finding of non-compliance with respect to conditions and procedures for contract termination. Can be viewed here http://www.comreg.ie/_fileupload/publications/ComReg13114.pdf

How is a written email not "in writing"?

And make sure that if you do pay the cancellation fee that it is free from VAT. I got a bill and they had to remove the VAT from their 25.18 cancellation fee and reproduce a corrected version.

This has been dragging on for some time, before you pay anything it is worth checking the position with ComReg (quote the reference supplied by CASEsensitive) - for anyone that has paid this previously it is also worth checking with ComReg, regarding a refund.

under european law i would say they are illegal as they are locking you in past your contract, many people signed on before they brought in the 30 days

once you 12 month contract is over its over, eircom needs to be sued

    its anti competitive
