Septic tank and Public road

    Looking at a house for sale where planning was granted for a extension and a new septic tank back in 1976. The only planning condition stated that !the septic tank was to be 60 feet from the public road"
    The roadway passing the site is not public, by my definition, in that is is not in charge by the County Council.
    The septic tank is over 60 feet from the house but it is less than 30 feet from the roadside fence.
    What is the definition of "public road" and is there any problem with the position of the tank?

    The septic needs to be 3 meters from any boundaries. Be it a road or bounds ditch or neighbours. I think you should be ok.

    from what you have explained, it would appear that some work is required by the seller to rectify this mater. this may be as simple as the seller submitting an engineers report stating the waste water system is working fine in its current location and request the council acknowledge its 30+ year location is acceptable.

    it has been confirmed in this linked thread that you are not qualified to give this advice besides the OP is asking a question relating to planning. which is different to the min distance allowed for a waste treatment system

    Maybe I should have said house is located in County Waterford. WCC have old bye laws, still in force requiring the tank to be 60 feet from house/public road and otherwise in accordance with SR6/ EPA guidelines.
    What was important is "public road" Found definition in Roads Act. It seems that is it a road taken in charge by the Council.
    As the road adjoining the site was not a public road, the 60 foot separation was not required.
