Sale of house - minor is co-owner

    Hi Everyone,

    Im new to boards, im hoping someone can help me.

    My father died two years ago and he left his house to me my husband and our 6year old daughter as tenants in common with equal shares.

    Does anyone know if me and my husband can sell the property even though our minor daughter is a co owner? Obviously we will keep her share of the proceeds in a trust until she reaches 18.

    Any help or advise would be greatly appreciated.

    You have a fiduciary duty as trustee. You can see more about this by googling fiduciary duty. That will be a rough guide of what you can and can't do as a fiduciary.

    In the event of the house going on the market, you will need to seek legal advice in relation to the sale and whether you are fulfilling your duties.
