P/T Annual Leave, Irregular Hours

    Hi guys,

I would appreciate if somebody clarify me with the following issue while calculating an annual leave using "8 % of total hours worked" method, as I am in part-time employment with irregular hours each week.

    1. Whether an annual leave already taken included or not, e.g. I took 3 weeks during the year and was paid for in average 19 hours, should they be included in total or not?
    2. The last holiday week taken I got paid only 10 hours. Employer believes that this was all that was owed, however if to take 8% from total hours in 2013 I should be entitled for 22 hours for each week.
I wonder should the Company at the end of the year pay me the hours shorted for during the year?

    Thank you!

Any help? I think under the Organization of Working Time Act 1997 public holidays and annual leave already taken are included in total hours to calculate 8 %, however how it works in practice I dont know...
    Thank you
