knocking bridges

    This may be sub-judice...

    There was a killing in Tallaght over the new year.

    At the Arrainment/bail hearing/whatever it's called here (I'd like to find out)
    The judge said to the gardai to write to the local authority to knock the bridge the killing happened on.

    Firstly. There's any amount of bridges that a person can be trapped by gang blocking both ends of a bridge.
    It seems strange that a bridge is more dangerous because some killers killed some one on one particular bridge.

    Secondly (and much more hypothetically). Is a judge telling an Gardaí to write something specific, to a planning authority, a "court order"
    Could the gardaí who were there a) not bother to write as the judge didn't go through the chain of command
    b) ask their superior officer to see if they need to write
    c) write a letter but clearly show their disapproval with the judges order
    d) ask the judge to do it
    e) ask the judge to pay the same fee as ordinary citizens to make an observation regarding planning ( tongue in cheek...)

    Thirdly can a judge extinguish a right of way, because a crime happened on that right of way( hard to see, due to all the speeding that happens..)

    I read this in the paper. Next he'll say we have to knock down the dangerous places where walls meet as people can get trapped in these so-called corners. Interesting to see how much weight this carries.

    Arraignments take place in the District Court. I am unsure whether that jurisdiction carries the authority to order this.

    Circuit Court.

    No jurisdiction there or in the District Court in respect of what's reported. Amounts to comment from the bench.

    Wouldn't mind the bridge is only a few years old and it was a huge improvement over the previous bridge

    Well, both are equally non-binding on whoever the comment might be directed to, but perhaps such persons as are pleased to follow reports of district court proceedings might consider the views of such an eminent judge to the effect that demolishing a bridge will lower the crime right worthy of paying the degree of heed and attention to which comments of that nature from that source are entitled.

    In medieval times the bridge in question would be put on trial, but that's just mad *koff*

    If the existence of the bridge is not the matter before the court, can he make an order to demolish it?

    If I am charged with dangerous driving and it transpires that I was driving a Ford car, can he ban Ford cars?

    I'm a non legal person but my answer is "I don't think so"

    AFAIK There has been no conviction or finding of any sort by the court, it was a remand hearing. The unfortunate Gardai have the problem of what to tell him at the next sitting!

    Sooner or later someone will probably get killed crossing the road and the coroner at the inquest will recommend that the bridge be rebuilt...
