Car without logbook

    Hi, i bought a car on december, and paid it in cash. I was promised the logbook and the sparekey at the same evening.

    Ofcourse i didnt get those, and the seller now just keeps saying that he dont have the logbook, and it even seems that the car is not even registered under his name, propably his sisters husband.. (i got the name and address from him). Also i tried to register it to Eflow, couldnt do it, since there was unpaid trips..

    It has now been 1 month, and he just keeps saying that i need to go the Gardai station and order a replacement.. well.. i cant since im not the current owner..

    Im going there anyway on monday, with the paperwork, email and sms trails that i have:

    1) Bill of sale.. but i think this is quite useless, since it is including the wrong owner details..
    2) Copies of his Irish Social welfare card and UK driving license
    3) Wittness statement who was there with me during the car sale.
    4) All the emails and screenshots of the sms where i have demanded the logbook replacement and the spare key and his replies

    I know that you shouldnt buy a car like this, but i trusted the guy, and the car is quite ok aswell. Stupid me..

    Do i have any outcome on this, aka is there any chance of me getting the logbook?

    Im also concidering to reporting the guy, i think this is quite clearly fraudalent sale, what do you think?

    The fact that he is still in contact with you suggests that its probably not fraud/a scam.

    As a buyer you dont get the logbook; you fill in your details and the seller sends it to Shannon themselves (if they have any sense) for the change of owner to take effect.

    Just bear in mind that while the car is still registered to the old owner, they are still liable for things like parking fines, toll charges, speeding tickets etc... ;)

    Yeah, the problem is that my insurance needs to be renewed on 27th of january, and i dont feel confident to do that on a car, that is not under my name, and i dont think that is permitted either.
    The tax is paid until end of the february.

    Just emailed to Shannon motortax office to see, what they suggest. I think the guy is just lazy and dont want to bother to get the replacement logbook.. too bad for me though :(

    Tell him as he is the registered owner or his sister then they are obliged to apply for a new log book and that you are reporting them to the gardai as the regd owner is committing an offence by not forwarding the tax book and new owners details.

    Im sorry I don't mean to be unhelpful here, but why did you buy a car with out signing the log book?

    OP did you fill in and sign the log book?

    If yes, did you check the VIN on the log book against the cars VIN or at least the reg on the log book against the cars.

    I was ment to sign the logbook later on that evening with the seller, but how convenient, he couldnt find it..
    as said before, i know it was stupid from me to do so :(

    the proper owneer could also ask for their car back or report it stolen , it shoudent have been sold to you in the first place with the log book

    Visited the local Gardai station, and they called to the guy aswell.. he promised to fix the logbook fr the prev. owner, but Gardai checked their details from some database, and told me that i should not hold my breath, and get a solicitor letter sent to the motortax office, who then can perform the ownership change.

    Car was not stolen etc, and it was otherwise ok in their internal registers etc.

    He cant change the owner details one way or another without your details and signature.

    Give him a deadline to produce the logbook (and if he does sign it on the spot and walk him to the nearest post box!) and after that get a solicitor involved perhaps.

    There is a process of claiming ownership of a car in your situation. You need to fill and a sign a form with a solicitor and send it to Shannon. Then they will contact current owner to see if he/she wants to claim ownership in certain time. If they don't claim ownership, they will issue a logbook on your name.

    Been there done that and Shannon sent me the log book they are very helful, it happens.

    The problem with contacting Shannon for a replacement is that they'll contact the current registered owner to confirm the car is sold. The last owner could just as easily tell Shannon that they still own the car, and since the OP hasn't signed the log book, there's nothing concrete to say he owns it.
