    What is the situation with buying a second hand with no tax that has not been declared off the road- is the buyer liable for tax back to the date of previous expiration date? Or just liable for tax from the date of purchase?

    Can't beat Citizens Information.
    If the motor tax on your new vehicle has already expired, you are not liable for the arrears period from the expiry of the last tax disc to the end of the month immediately preceding the date you bought it.

    Another quick one- can a new tax disc be issued to the new owner if the car had no tax paid for 2 months previous (and was not declared off the road)?

    The new owner is only liable from the month of the change of ownership...

    Yes!
    The not not declaring it off the road is not your problem you've only just purchased it, so tax will be liable from the month the change of ownership happened.

    I was getting a bit confused, as I thought they chased up on motor tax arrears where the car had not been declared off the road.

    I just don't want any hassle when trying to tax it from my date of purchase where they'd say the car cannot be taxed until the previous months expired tax was paid.

    So basically, the change of ownership to me erodes the the motor tax liability for the seller?

    In theroy let's say your tax is out since last February, you decide to sell the car with no tax, so your not liable for the unpaid tax and the person buying it would be only liable for this months tax?, correct?

    If that's correct, I could sell the car to the wife and save nearly a years tax?

    yes this is currently a loophole...They are planning on closing it off somehow.

    By introducing the system fully like in the UK No doubt.
    If car is not taxed and not declared off the road, fine issues automatically and that fine must be paid. Selling the car will not cancel it out.
    I can't believe the half arsed way they brought this in here.

    Yes and no. Legally because you're married, you can't really "sell" the car to your wife because it's already her property. So your wife as the joint owner of the vehicle is already liable for the year's arrears. Putting her name on the VLC doesn't change that.
    The motor tax people could legitimately prosecute you for tax evasion/fraud.

    So what your saying is sell it to her sister and you'll be fine :)

    Big bold sticky is needed. It killed off the fog lights so maybe this too.
