Waste collection at 5:30 - laws about noise?

    Was awoken at half 5 this morning to a bin lorry pulling down our road and spending 5 minutes banging round. Live in the middle of a quiet estate.

    Before I lodge a complaint, wanted to check if there's any laws that actually could be used to ask them to stop, or if it's a case of just asking them to be considerate without any backing legally.

    There's been issues in the past with other waste collectors who do these early morning pick ups and then get complaints about them, but this is the first time I'm writing to one asking them to be more considerate. Just wanted to check from a legal stand point what rules are there. Have a feeling there's something about not making noises in residental areas before a certain time for instance, but what I'm reading is that it has to be something more consistent than a once off, half-5 bin collection.

    Better than them destroying rush hour traffic between 8am and 10am in my opinion.

    There are plenty of effective earplugs available from chemists that cost next to nothing, particularly if noise is only a problem one morning a week.

    The men have a tough and pretty awful job to do. Complaining about the time of day they do it is just going to make you look like a cranky, entitled asshole.

    If it's not going to be your quiet residential area at 5.30 am, it has to be someone else's.

    Or maybe someone who is asserting his rights under the local by-laws. For example in Dun Laoghaire-Rathdown it's not permitted to collect waste between 9 p.m. and 6 a.m. on the following day without the prior approval of the council, approval which I suspect would not be granted for residential areas......

    8. COLLECTION OF WASTE

    (a) The approved times for ordinary household and commercial waste collections which are in operation at the Commencement Date of these Bye Laws shall continue until a revised schedule is notified by the service provider.

    (b) A service provider shall not collect waste between the hours of 9 p.m. and 6 a.m. without the prior written agreement of the Environment Department of the Council.

    Being honest, I didn't post in the legal section for a debate on how hard a job it is (which it is) or if I'm an "entitled asshole" cause I'm annoyed at being woken at such an early time.

    I just wanted to know what legal backing I had with the issue. :(

    I think 5.30 is way too early, and the difficulty of the bin mens job has nothing to do with it. OP might have a difficult job or shift work and should be entitled to not be woken up at such an hour so he can get proper rest. But I guess you need to contact the council and find the statutes in place like yer man above has linked to for DL.

    It could be worse though OP, I was doing 12 hr nights 8pm to 8 am last summer and had to try to sleep during the day while my next door neighbor (terraced houses) remodeled his whole house starting work at 9 am going until 6. This remodeling included using a jackhammer to break up his whole floor one week, redoing tiles on the roof another, removing Ivy growth from the exterior walls with a hatchet, and it went on all summer, constant hammering, when it was already hard to sleep during the day with the heat and bright sun, kids playing outside, etc. And I had no recourse at all due to the fact it was daytime, when apparently it is legal to cause what sounds like an earthquake all day long no matter how close your neighbors house is.

    Not necessarily. They can change theit schedule start across all areas.

    I agree with Hullaballoo for once. if you live in a close-knit society you have to realise that certain things have to be done and there are only 24 hours in the day, pick a different time for the waste collection and there is a different problem. I would hate to be trying to provide a service and deal with people like you at the same time.

    We have up to 5 separate bin collectors come throughout the week. The cherry is they reverse down each road too so the reversing beep beep is a constant.
    Between 2000 hrs and 0800 hrs decibel levels have to be under 40 I believe.
    I went to the local authority enforcement officer also their scientific officer and got the situation resolved. Ps she was also my boss. Once a week is one thing. 3/4 days a week with 5 trucks in that time frame all beeping, I feel your pain.
    I don't know what act she pulled the 40 decibels out of, most likely Noise Pollution. Hope that was some help.

    I would say most people now have there bins collected. Why is that been privilaged. I call is a service and one people pay for. Half 5 in the morning does seem very early.

    Not speaking for hullaballoo, in my case I have to put it in the car, take it to a landfill site and pay €5 per black bag.

    I think rereading (which is a good thing to do) the post I quoted was that you are a privilaged person if you have a wate collection and you should shut up people pay a pretty penny for the service.

    Sorry to bump a thread that was a bit OT anyway - but is there seriously nothing that can be done about the bins being collected so early in the morning?? Since the new year one bin company in our estate has been doing it's collection at 5am. They were previously 7/8 am - sometime 9.


    I rang to complain and was told that they had changed their routes and would now be collecting at that time. Every time they collect I am woken by the lorry and the noise of bins rattling. I am just back into a proper sleep when my alarm goes off and I am out of sorts for the whole day.


    I rang my county council today and they said there is nothing that can be done about it! Seriously??

    Sometimes it depends on the person that answers the phone. I would suggest that you ring again, ask for the environment department, and then ask to speak to somebody about making a noise complaint.

    If you don't get anywhere with the refuse collection company or the local authority, you could get on to the EPA.

    I worked in a residential house caring for people with disabilities and the bin collections were also at ridiculous times. The noise woke the residents which meant they were often angry and confused creating all sorts of upset. It was hard work as only one staff stayed over during the night on an 'on call' basis meaning if residents didn't sleep neither did staff. Eventually we phoned the company and explained our situation and the route was changed.

    I doubt it is 40db. Normal conversation is louder than that. If that was the case I couldn't stand outside my house and have a conversation with a leaving visitor or something. I couldn't drive my car out of my house.

    Check your local authority website, I seriously doubt that Dun Laoghaire Rathdown co. co. is the only local authority that has by-laws which sets early and late limits on times for collections.

    And even if there are no relevant bye laws in place, apart from whatever else can be done, County Councillors are usually willing to keep their constituents happy by putting the necessary in place.

    Especially if you call to their house at the same time as the bin lorry called to your house the previous night.
