Hi all.My wife parked her car this morning and went to work.Car was parked on empty car park and girl who work next door hit my wife's car from behind. She could not explained how did it happen. Her car has no tax and NCT (well she said she booked :P ).She damaged rear bumper and tailgate wich is leaking now.It does look bad...She gave me all details so I called on wife's behalf as im named driver to report it to my insurance.Few hours later I called her ins.company but she didnt report this at all.
Called Gards but they wont be involved.
My question is what will happen if she wont called her ins copmany?we were never involved in car accident so we dont know.
Also she offered me cash(300-500) but the damage will be much more(new parts etc)
My cars is Scenic II,its not worth much so could be write off...
    Any advice?

Contact her insurance company. (Get details from disc, hopefully she has some)

  • Registered Users, Registered Users 2 Posts: 740 ✭✭✭Aka Ishur

What is leaking from the tailgate!? Let your insurance chase her, they should be doing the work.

I did call twice and she did not call them at all but when I spoke to her she said she did.I said loud and clear that she did not and she did not know what to say.

Well water is coming through ...

Wouldn't surprise me if she didn't have insurance tbh... no nct or tax, offering cash to fix. Have you got fully comp insurance?

All you can do really is report it to gaurds and to your insurance company giving her details, which you've already done.

This is why we pay for insurance.

If the stupid girl wanted a clean window to look through she should have used the extra visibility and not crashed into your wife's car.

Would it be possible to do a deal with her i.e get a price from a body builder and ask her to pay

you may lose your no claims bonus if you put a claim in with your insurance even though its not your wifes fault

Why would she even consider putting it through her own insurance ?

    How?

  • Registered Users, Registered Users 2 Posts: 844 ✭✭✭bigboss1986

We will be claiming of her no matter what.As far as I know she is 21 with learner permit and named driver on boyfriend's policy.Boyfreind was an absolute c*nt so I lost control over the phone but when he saw me he changed his mind (yes Im bouncer :D) but anyway she was crying that he will loose bonus etc etc .Personally i think that he mixed up brake and accelerator ...
But anyway like I said what is worrying me she lied that she called but They gave all details without problem.
What is worse engine light came on and car is misfiring as well.

I have photos taken but they wont judge. You have to open the boot to see parts of body moved to the front .She is saying that it was only a 'tip' but it was not.

Not being bad but maybe it was a mistake maybe she got a fright as u said she's only 21 insurance is expensive enough.why not talk to her and see will she pay rather then doing it through insurance.like if she pays what's the problem. I'm a mechanic and hitting the back of a scenic 2 will not cause a miss fire it's impossable. Give the girl a break it's Xmas week just because it a bouncer maybe u where intimading her u seem to be coming across very abrupt hear. I'd give her the chance to pay if she didn't then claim.
I'm sure if it was u that hit someone I'm sure ud like that option.
There's no need to go to town on them life is hard enough without these stupied set backs.

And honstky hitting the back of the car woukdnt cause any engine problems and if u say that to the insurance there gona know and think ur trying to sceam them and a asseor will tell u hitting the boot and bumper won't cause this problem.

If I'm correct the scenic is made of plastic and any good panel beater would fix it up up for about 500 euro.
Come on think about it. A young family the week of Xmas and there prob under pressure ect ect talk to them work it out don't go straight for the kill.

    Think we found the boyfriend...

Sounds like they're trying to dick you around, poor form.

  • Registered Users, Registered Users 2 Posts: 7,302 ✭✭✭Supergurrier

So you think being down 500 quid Xmas week is better than losing some no claims, cmon get real.

Go through insurance its not worth the hassle just to get led on a merry dance and you are obliged to inform your insurer regardless

Well she was sound to talk only boyfriend was p*ick when he said he can fix it for 20 euros...I did not raise my voice or shout on them at all.I think u r right about misfiring it is coincidence. But anyway I was left with car with leaking boot for xmass/new year I have 2nd car in family but it is my weekend-sport car no good for shopping etc.
The worse thing is my wife loves the car and she wants to be fixed to the same (or better) state than it was so I have no other option but as adviced I will be putting pressure on the insurers

  • Registered Users, Registered Users 2 Posts: 501 ✭✭✭burke027

Well there's ur statement there I WANT IT FIXED TO BETTER STANDERD THEN WHST IT WAS.
Shows what ur thinking.I was only making a suggestion.and who ever made the comment about me being the boyfriend I haven't even a clue where this happend and I'm prity sure if mywoman hit my 5series off something I'd known.
I'm only trying to state that it was a accedint and they do happen if she offered to fix the car and she did I would be happy with thst.
My point is people are under enough stress as it is if there's a friendly way out why not use it.as I'm sure if the op hit some one he would like the same to be offerd to him

Dont get me wrong but if I will get sorted in the nearest future whoever is going to fix wont leave scratches so yes it will be BETTER state.I didnt say that I want new car.

I bet u will be angry as f*ck if she will hit ur 5 series on empty(yes empty) car park.
I only asked here for advice as we were not involved in any minor or major accidents but after reading ur posts what will u do If u would hit my weekend BMW M3?Would u pay 2k++ for bumper and boot?

this happened to me last year.

my car was parked and some woman reversed into it while i was in my apartment.

i decided to be sound and said we could settle it without her insurance getting involved. i deeply regret this. i wanted my car repaired at toyota but they wouldn't pay for that, i ended up having to use their bodyshop. in fairness the work is flawless but the damage was light.

if i could go back though, i'd just ring my insurance and let them tackle the whole thing for me. the hardship i went through was epic dealing with the other party.

OP, ring your insurance company and let them handle this for you 100%. that's what you pay them for. that's the advice i got on here last year and i ignored it unfortunately. no point stressing yourself out dealing with people who don't want to be dealt with.

Miss fire could be caused by the bump shifting the ****e in the bottom of the tank.

So what was the problem there, because - as you said - the repair was flawless. Was it just dealing with them, or am i missing something obvious from your post?

just that i was a ****ing pushover wimp.
they hit my car through no fault of my own, i should have stuck to my guns and got the repair where i wanted but for some reason i felt sorry for them. the second they stopped playing ball i should have let the insurance pursue what i wanted.

they were awful to deal with, passed from the wife to the husband, back to the wife, to their bodyshop fiend etc etc. i'm just lucky that their "friend" actually had a well established professional outfit and the work was done well. but it could just have easily went the other way, some botched back alley job and then i'd be in too deep to turn around.

moral of my story. if the other party aren't giving exactly what you want. let the insurance pursue it for you or you could well end up with regrets.

Don't underestimate damage, If you're going through the insurance they'll check properly, but don't accept cash to fix your bumper, only to find out you've other, hidden damage.

I'd go 100% insurance. Which one of them was driving, him or her?

It was her driving. After reading all the posts and talking to friend of mine who is panel beater I have no doubts that I will go with insurance.
Friend of mine has bodyshop and because his busy before xmass he is open today.Went an hour ago and he gave estimate well over 1000.
He said all the plastics and panel are expensive and can not be fixed only replaced and resprayed.Like I wrote before If anybody would look at it looks like small dent and bumper cracked

    @mlumley
We also checked with OBD and the misfire is on 3rd cylinder.Probably coil. Not bad.20-30euro ,easy job.

Only ever deal with someone direct if they are absolutely willing to play ball. You are doing them a favour by keeping the insurance out of it; never be afraid to remind them of that if they start kicking up a fuss.

In this case, if the boyfriend is causing hassle then Id just stop dealing with him and let the insurance handle it. If his NCB is that important to him then he can always repay the money to the insurer before renewal time and his NCB should not be affected.

If you require a replacement car then the insurance will most likely provide one, whereas a panel beater wont. Might be worth bearing in mind when making your decision.

You hope he's proud? Of what exactly? The guys trying to get his car back to original as he is fully entitled to do, whether that be through main dealer or independent. I myself have lost out to utter chancers having given them the benefit of doubt in this situation and I won't make that mistake again.( only had car 2 days at this stage).

But....but...it's x-mas week :D Actually OP, is it not x-mas week for you too? You shouldn't have to spend it worrying about trying to clean up someone else's mess. Let the insurance company deal with her incompetence.

I remember someone hiting the back of my car once and when i had a look at it i didnt think too much of it at the time. The woman that ran into me was in a bad way and i felt for her a bit.she wanted to pay me cash .I didnt opt for the money and said it had to go through her insurance. When i took the car to the pannell beaters yer man said i would get a new bumper out of it.But looking at it it could of being fixed up for 300-400 .The lad just laughed at me and said that even if it was a little scatch he would put in for a new bumper.I felt this was easy money for him and suggested it was unfair on the person that hit me.she will lose her ''no claims''.could he repair it and she could pay him cash.At that moment she rang me and said to get a new bumper and go through her insurance,Yer man in the garage had a good laugh and said to me ''look after number one lad'' i did and got a new bumper out of it.

    Exactly.
A few posts here saying it's nothing without even seeing the car, should be ignored.
Get your car checked out properly!
To the lad that said he's a mechanic, what if the shunt dislodged a fuel line from a clip and gradually wore a hole in it because it was rubbing against the frame?
I say this because I have seen this happen to a car.
As I said OP, get your car checked properly.

To make long story short my car was checked today by 3 different body shops. All of them said that it is write off and for insurance company it is not worth fixing it.
3rd party ins company will send an assessor after holidays.Car is worth 1700-2300.If its really write off what can they offer? Some money and they will leave car as it is or they will pay ''full'' (yeah right.. :D ) value of the car?

Yep, that's exactly it. That's even before you'd get a penny out of them...no guarantees of that even happening either.
Too many jokers out there to take the risk. Glad it's getting sorted through the reliable channels.

So it turned out to be a storm in a tea cup.
These things happen and she is dealing with it in a proper fashion.
A young girl will get a shock when something like that happens and she needs time to get to terms with it.
As it was she complied with the RTA in that she gave the apropriate information and if she was driving without insurance and failing to repair your car the Gardai have a month in order to make a demand.
Its a long road, its nice to be nice as It may be you or your wife next.
    Happy christmas.

She f*cked up and he was trying to say that there is no damage done.Shocked when I got 3 estimates today

    Any advice?

After xmass my car was checked by assessor.3rd party's ins wont fix it ,described as ''economical write off''.3 days of negotiations and I agreed to take check and ''sell'' car to Lib*rty.
They will contact me 2moro but my question is what do I do with log book??I have to give it to them or send to Shannon with ''new owner details''.That might sound stupid but I dont want get unpaid M50 tools etc,etc :D
    Any advise appreciate :o
