Notice Period and Christmas Holidays

    I have handed in my notice to my employer today and I hope to finish up Friday week and use my holidays owed to me for the Christmas period. Effectively my termination date would then be 31st December. What I am wondering is, in order to calculate the leave owed to me, is it up to Friday week that I pro rata it or is it to the 31st of December? The company year end is April 30th.

    It's up to the date you officially terminate your employment. So better to give notice to 31 December and then request that your holidays be used in lieu of notice. This way you are technically on holiday over Christmas and new year and you still accrue leave while on leave. If you state your finish date as the 20th you only accrue leave to that date.

    Bear in mind however that your employer is under no obligation to allow you to use leave in lieu of notice and can request that you work the full notice period.
