    Apparently I'm over by 0.21 hectares in my payment. They seem to have drawn lines against a small drain down the middle of a field and around a couple of trees that have grown substantially in the last 10 years. I don't suppose there is any point complaining is there?

    Is the wooded area fenced of? If cattle can still graze I would deduct an amount for the trees. If fenced off then hard to argue its eligible.

    My advice which I done similar myself, is that if you have more land than entitlements after the reduction of 0.21ha to just say, yip your right for this year as if you challenge god only knows when you get paid. Next year put in the correct ha amount again

    My information is that the minor overclaims are being paid that's why Iasked you were you paid when I thought you had an overclaim.
    Any one who loses 100% this year will be penalised for the last few years if they have the same overclaim and have to pay it back unless Coveney can do something in Brussels, This will have serious implications.

    The trees have grown a lot in the last 2-3 years as they have finally managed to get to big for the cattle to eat the leaves and I imagine look very big from above! I'm going to check with Teagasc tomorrow but probably will just live with it!

    .21/ha......that's nearly the size of a site
    Stock are probably able to graze right into the butts of the trees, so you should only lose the size of the butts, not the size of the trees.
    Very easy measure the drain then

    Talked to Teagasc and they reckon it's worth my while to send an objection, especially about the trees. They said if it goes back a number of years it will add up to a fair bit. So here goes nothing!

    We got the same Katy, lodged an appeal as our adviser couldn't find any fault (it was him who did it anyway I think)
    Apparently if you have rivers on your land they will detract them from it:eek:
    As well as having very thick lines on the maps. We had to fence off one bit as it was too marshy and nearly lost a couple of cattle in it but we used it as habitat for REPS then.

    No harm joining the appeal brigade, let us know how you get on too:D

    From what I read, your appeal sounds handy enough. The thing to be wary of is if there's other things wrong on the farm and they send out an nosey parker inspector.

    That's what I'm afraid of too. God alone knows what someone walking around will find! Had an inspector looking at a map a few years ago. It looked like the fence was further in the field than it should have on the satelite pic - turned out that it was a shadow from high pine trees in a neighbouring forest. He stood in the field for ages as if by the power of his mind the trees were going to stop casting their shadow over the field:rolleyes:
    I'd better do a quick run around my fields.
    Anyway, I'll let ye know what happens next.

    I also got one of those letters.I was afraid to appeal just in case my payments got held up or I got a visit from an inspector who hates farmers.well I got another one today telling me that the over claim is back dated to 09 all the way up to 2013.They didn't take anything off me for 2010,dont understand that bit.It amounted to 518.16 euro.It says I have the right to appeal.

    I got a letter in the post this morning to say that I had been over paid in my disadvantaged payment by €3.28. They didn't say that i had over claimed or that i had done anything wrong. No the mistake was on their side and they say that if I don't repay it, they will charge me interest of 12% on it. They want payment by cheque or draft. Either will cost me more than I actually owe them!

    We got one too:eek: But ours is €39.36. It's a disgrace Joe......
    In all fairness can they not get things right for a change, it's a hassle now having to query every little thing with our adviser and he will probably go mad before Christmas trying to sort all these out.

    That €500+ is the profit in some animals it's worth going after. Think mine would be around 350 or so.

    Lol, what a fcukin joke, you'd think they'd just deduct it from next cheque and be done with it.
