Public Order - Gardai

    Hi

    So last night I get really drunk, and the problem is that I do Not remember what happend, I remember only that I was stopped by 2 Gardai officers and they said because I was screaming in public place and singing (Yes...) that is breaking the law, they took my ID, checked it and gave back, they asked me where I live and that's all what I remember, they said I need to leave because peoples cannot sleep, I left without any receipt/ticket so my question is what is the normal procedure? I know that tickets are sent by post but only for drivers isn't? What is the charge for insulting public place by screaming/singing? I was not aggressive by the way...

    There are two possible charges here really;

    1. Drunk in a public place
    2. Disorderly in a public place

    The first obviously applies, but Gardai are very slow to prosecute anyone for it unless they're a danger to themselves or others. It would be a busy time at the weekend if the Gardai were to arrest everyone who was drunk in public.

    The second only applies if you are instructed to desist and you refuse. In your case, it appears you were instructed to desist, and you did so, and went home.

    I wouldn't expect anything to come of it tbh. A summons could be sent out to you. But going by your description, you were co-operative and respectful so they let you on your way.

    four possible outcomes really...


    you can receive a fixed charge notice in the post exactly like a driver, you may receive a summons, you may be issued an asbo or you may have gotten away with it.


    drunken singing in a public place presumably with residential houses nearby could land you with a ticket. its a €60 fine from memory.


    no point worrying about it for a few weeks and see if you get anything anyways.

    Most gardai will give you a warning and if you continue to act the mick then they will fine you ....... this is my experience

    Only before Midnight and after 7am. In between those you are not entitled to any warning.
