Car Damaged while parked, what now?

    I live in a town, on street parking. cars park @ a 45' angle. I've cctv too.
    Anyway, last night some dope parked beside me and after 5 mins his car moved-he never lifted the brake or left in in gear:rolleyes:

    I looked at it this morning and it was lodged into my wing. I took the reg and rang the cops. it'd no ins disc and the tax was up. They had it towed. there's a fair dent on the wing behind the front wheel and over the wheel.

    Whats the routine now? Given the excess on my insurance it's hardly worth putting it through. do I tell them anyway and let them chase the owner of the other car? do I wait for the cops to get the price of repair off him before giving back the vehicle?

    any advice is appreciated!

    Ring your insurer, they're pretty good with dealing with this kind of stuff..

    Insurance will sort it out, either your man is insured and not displaying or not insured in which case MIBI will pay out. I think once you have the reg insurance will take it from there, that is what they are paid to do anyway. Excess shouldn't come into it as your not claiming off your own insurance.

    The guards will have nothing to do with the other person paying you and they won't hold the car till then either.

    Just back from broker. Told me to get an estimate for the repair.
    It's an 07 Lexus. I've a bad feeling I'm gonna get ****ed on this one. If I thought yer man was paying I'd take it to Lexus for the repair. If I've to take the hit I'm gonna give it to the local dude to save a few quid. Was told before if it's below 500 you're better off pay for it yourself.

    I can't believe the dope can get away without paying for my car. Surely the cops will be able to ensure he sorts it?

    I'm pretty sure the guards will hand over the name and address to insurance and so MIBI as well. Now that you say it Fred MIBI not paying out on on small claims like this does sound familiar, but I do think the OP would then have a case for a taking person to court, might be in the range for the small claims court, I'm no expert and maybe insurance can advise.

    If there's a local guy who does decent work, I'd give it to him as opposed to Lexus who'll charge you for the pleasure of handing it over to the local guy.

    And who's to say your other man will actually pay.

    A more fitting punishment because from the sounds of it, the fella hasn't got insurance.

    I don't think there is any legal basis here for a Garda to impound the car. If its taxed and insured (Which you said it currently isn't, but if it was), they can't hold it without due reason and an outstanding insurance instance is a civil matter. More over, if the car is collected on a trailer there is no basis for it to be taxed or insured. I could be wrong, but that is my reading of previous likewise encounters.

    Think you got dealt a bad hand here OP :(
