I work for a medium to large company who are starting a "restructuring" program, and the term flexibility is being bandied about, some of us have an indirect position which was advertised internally, we went through the interview process and were deemed to be the most suitable application and were subsequently offered the positions and had to sign a form to say we had accepted it. Now after some years doing this job with no complaints or issues from management about our work-rate or attitude they are to replace us with another operator and put us back into production and the job is to be rotated every 12 months or so. we have no problem with flexibility to which we have told management this but our idea of flexibility is if we have some spare time we go help in other departments but while we're doing so there is nobody doing our job. I know some people will say we're lucky to have jobs in the current climate and we accept that but all we want to know is if we can oppose this plan and hold onto our jobs as they are at the moment.

    2 things.
    1. Whats your question?
    2. Have you got a union?

The question is after we have been appointed can we be removed from our positions without reason.
Yes we have a union but they don't want to rock the boat in case it leads to more job losses

Hi, here is a link for CIC's info on changes to contact of employment.
    www.citizensinformation.ie/en/employment/employment_rights_and_conditions/contracts_of_employment/contract_of_employment.html

Remember custom and practice within the company will also come into play here but still I doubt they can do this without your permission unless they can show very very good cause

If your in a union andr you local rep is not helpful, try and get the regional rep to met with you

You should also give NERA a ring, although some people do feel they are showing a bias towards employers at the minute.

That's kind of how I was thinking. I was of the mindset of there must be something legal there otherwise the management would have just shifted us no no questions asked. Thanks very much for the links. I'll check them out
