gaurding at first floor windows

My reading of Part K is that it requires a - Guarding should be provided for any window, the sill of which is more than 1400 mm above external ground level and is less than 800 mm in height above internal floor level. Where a window is capable of being opened, special care must be taken to ensure that the guarding must remain in place and effective at all times - my situation is that window boards are at about 500mm above floor level at first floor level, the windows are fully openable (if restrictors are removed/released). Can I fit a balustrade of say 300mm high of 50 x 50 vertical timbers at 100mm spacings on the front edge of the window board to provide a guarding 800 high?

My concern is that a child might be capable of using the window board to climb the guarding and fall out the open window.

I don't want to use toughened glass.

    Any comments please.

    Regards,

    James

I know there is a long post somewhere on the subject but I've always found this subject matter a bit onerous.

Toughened glass in the window would only be advantageous if it is a fixed panel, if it is openable then guarding would be still required.

I did find this information sheet regarding children and windows with guarding but again all situations are different.

Re the toughened glass - should have said that I did not wish to fit a glass balustrade in front of the openable window.

this situation is in the rep of Ireland - think doc referred to above is relevant to uk?
