Hypothetical penalty points question

    I bought a car from a dealer a while back and only noticed when my tax was up for renewal that the name on the log book was spelt incorrectly. I'm getting it corrected now but in the past year if I had committed an offence, the name on the fixed charge would have been wrong.

    Would I have gotten off on a technicality or would I have been liable for some other offence like not having the car registered properly?

    I'd say you would get jail for driving a car that's not in your name. It's effectively stolen.

    You are also driving around in uninsured car as you would have certified to your insurance comthat the car is registered in your name when it is not.

    If the two extreme technicalities above don't apply then why do you think a technicality which suits you would apply

    I assume the spelling mistake is something like Jack Presley/Pressley? if you were caught speeding and you mentioned the name on the summons being wrong in Court they'd alter it there and then, you'd still be facing the same outcome. Similar with the log book, just get it fixed and your grand.

    There was a time where you might have gotten off on a technicality, but now they will just amend the details and proceed as normal (assuming its just a minor typo and they dont have the entirely wrong name/address etc).

    SO it's not as hypothetical question at all :D It's a can i get away with it Question.

    Answer is sure you can,i've sent my VLC off to Shannon just now,i hypothetically sold my car to a Mr. Tossy, 47 Boards street,Internet town. :D I really hope he looks after her.
