Certificate of Compliance needed

    We have finally got a mortgage and have been into the solicitors. We signed a few things and then he gave us a list if documents he needs. Some of the documents I imagine he can only get once it is built? He wants
    -Certificate of compliance with the conditions in the Planning Permission
    -Certificate of Compliance with Building Regulations
    -Letter of Compliance from County Council in respect of the relevant planning conditions
    -Architects 6 point certificate to certify that he inspected open foundations and that he supervised the construction of the new house

    Can I get these before I start the build or will they have to wait until the end. Probably a very stupid question but any help would be gratefully appreciated.

    No such thing as a stupid question.

    Anything to do with compliance can only be provided at the end of the build - your architect (RIAI Registered) can do these things once they are appointed on (ideally) a full service basis - i presume you will want them to provide a full service for you i.e. planning, tender drawings, site supervision, certification etc etc.

    I take it you are using the mortgage to fund renovations or building works.

    In my own case the bank wanted a 6-points letter from an architect, in advance of any mortgage drawdown, that he would supervise the works and provide certificates of compliance etc. as the project went along. The letter was a standard piece of boilerplate like this:
    I ______________________________ (in block capitals) confirm the following:

    1. That I will supervise the construction of the property

    2. That I will inspect the open foundations and certify their adequacy

    3. That the property will be build by direct labour and no building contractor will be retained

    4. That I will issue a Certificate of Satisfaction and Compliance with Planning Permission and Building Control and Regulations on completion.

    5. The approximate cost of construction is: €_______________

    6. That I attach a copy of my professional indemnity insurance

    Your bank may have different requirements but they should be able to give you some standard text.

    The other items are usually required as you move through the project, but your bank should be able to indicate when they need these. If you are drawing down the remaining mortgage in stages as the building moves along then the bank will usually ask for certs of compliance to the particular point at which the drawdown is taking place and will provide you with their standard form.

    In my case the conditions were in a "Special Conditions" section in the mortgage offer letter.
