Is it ok to break a contract without even starting yet?? PLEASE HELP

    Hi guys,

    So I got offered a position at the moment that I am not overly excited about but hey its better than what I am currently working. Thing is they sent my contract and asked me to sign asap so they know I am definitely on board which I will be starting after the new year. However, I still have another interview which I am through to the next round which is the one I really want. That interview is not till the end of November.

    So my question is, if I was to sign the contract being offered, went for the 2nd interview and if luckily, that I do get offered that position, would breaking the original offered contract be illegal and could anything come from it before I even started? Please help as I do not want to reject the chance for the second interview because of the current offer.

    It's a pain for employers, but it happens quite often. We've even had people tell us on the day they're supposed to start that they've taken another job. Someone interviewing for a job is rarely not interviewing for another one.

    Nobody here can give you specific legal advice though.

    Frankly, they're asking you to sign up two months before you start - is that some kind of joke?

    The company wouldn't think twice about changing their mind if it didn't suit them to take you on after all. Neither should you, IMHO.

    Yea thats what I thought. They were VERY keen on getting me to sign the contract asap. But I am just afraid that if I do sign the contract and get offered another position (the one I actually want) I wont be able to accept that position because of the contract situation....

    Does probation work both ways? It did once for me in the past.

    So what do you guys think? My head is absolute melted here with this... Should I sign the contract and see how it goes and if I do get offered that other position I will have to tell them and break the contract?

    Look after number one in this life always, particularly when it comes to employers.

    You do hear of people signing the contract and backing out all the time, usually because another offer came through or similar.

    You must always look after yourself in this scenario but I would always tell people if you do this to a company accept that there is a good chance they wont even look at your CV for the next few years if you apply again.
