fathers acess to childrenafter divorce

    Hi, i have beed divorced for a while with access arrangement in place. I havs two children one of them does not want to go for overnight stay witb their dad as the arrangement states. At 6 can he decide not to go, and can i be taken to courts for that?
    Your help greatly appreciated.

    You have to comply with the access arrangements AFAIK.

    Have you sat down with your son and had a chat? Try to find out why he doesn't want to go. Are you on speaking terms with his Dad? Maybe the two of you (if you are!) can come up with a solution?

    Hi Op Id be all for the sitting down with the childs father and discussing it if you can.

    Perhaps the child is just a little bit unsettled and unsure of himself at the moment.

    With regards to the visitation issue, if you have court ordered access you cannot break it unless you go back before the judge and explain how the child feels and the judge then changing the arrangement.

    I stopped my son going to his father one night, which was court ordered because he was upset about going and all hell broke lose.

    When we went back before the judge he tore strips off me but I can see why my sons father was upset he wanted to see him and spend time with him too.

    Unless there is a bad reason for your son not wanting to go I would encourage you to let him he needs to have a relationship with him too its only fair

    Why does your son not want to go?
    Is it the way he isn't happy with his dad?
    In my opinion it is important for your son to build a loving and health relationship with his dad. For this to happen you might have to encourage your son to see the qualities in his dad/that his dad loves him/build a positive image of his dad to him.(He has to be safe/cared for in the dads company, first of all).
