First Time Claiming - Partner On Unpaid Maternity Leave

    I finished up in my job yesterday and went to my local Social Welfare office this morning to sign on. I was given an appointment for next week and forms to fill out and bring back with me.

    One of the questions on the form is about whether your partner / spouse is in employment etc.

    She is, but is on maternity leave at the moment. She currently only receives the state benefit, and has a period of 2 months leave off work unpaid when her maternity leave runs out.

    So she will receive zero from her employer as well as zero from the state benefit for a 2 month period.

    I'm wondering what to put on the application form - as technically she is in employment but is on leave until next year....?

    Any thoughts appreciated.

    As you point out she is technically in employment, you need to put that down on the form.

    Yes I will - the point is that her employer is not contributing to maternity leave so she won't have a salary until going back to work some time early in 2014. So will that have any influence on what can be claimed for? As I said I'm completely clueless about all of this. Never been in this situation before.

    When she is on unpaid leave you can provide a letter from the employer confirming this and you can receive an increase on your claim for her then. While she is on Maternity Benefit you cannot claim for her but you can claim half rate for any children. You will probably need to provide proof that she does not receive payment from the employer during maternity leave to claim for the children.
