Public Holidays

    So this last Monday I was off work, I am off work EVERY Monday... I work Tuesday through Saturday.

    My employer insists he does not owe me an additional day off or pay in lieu.

    Could someone here enlighten me what the legislation on this is?

    Legislatoin...Im not 100% sure of..:confused:
    BUT...:D
    In my experience if Monday is one of your normal working days then you get it off but if not you may not be entitled to a lieu day.But if you're contracted to x amount of hours over x amount of days theres no specifics there of working days and you would be...I think the hours you get for a Bank Holiday are based on the average hours worked per day over the last 13 weeks...and if you work 40 hours tuesday to sat you would be entitled.
    Oh Im confusig myself......:o

    "For an employee who is not normally required to work on the day on which the public holiday falls

    If the employee’s pay is calculated by reference to a time rate or salary, he is entitled to pay equivalent to one fifth of the normal weekly hours last worked before the holiday;

    If the employee’s pay is calculated by reference to a piece rate, he is entitled to one fifth of the average weekly pay calculated over 13 weeks prior to the public holiday."
