Party Chimney Dispute

We live in a terraced house in Cork city centre. We have recently developed an issue with the chimneys in one of our party walls. When we light a fire in our fireplace, everything is fine on our side, and everything is fine on their side, but when they light a fire on their side, smoke pours into our attic (and then down into our house.)

I know nothing about party walls, but I am getting two opposing points of view here. My friend who is in the building trade says this means they need to have their chimney relined and is the responsibility of next door. The owner of the house next door says this means we need to have our attic wall re-pointed and is our responsibility.

I basically have no idea what to do here. I'm perfectly willing to have the attic repaired if this is my shout, but what type of builder would I call to do that? And how do I determine if this is my problem to sort?

    Thanks for any pointers :)

    both should be done.
Their chimney shouldnt be leaking so needs to be fixed, for your sake you need to re parge your walls to prevent smoke from any fire in their house entering into yours.

    Hi

Get smoke alarms for rooms concerned.

    Agree with other poster.

Get professional advice. Employ A good solicitor he/she will recommend a Forensic engineer. Check with Engineers Ireland. Source a specialist chimney company. Good Builder.
You need to deal with this.

I had same situation in the past.

Do not sit on this - be careful and thorough.

Check your insurance - it may cover it.

    +1

Smoke should not be getting out of the flue but if it does you certainly don't want it getting into your property so both should really be done.
