Parking ticket question

    ive a feeling this will start a bit of banter... I got a parking ticket today. fair enough, i was in a rush for a meeting and didnt take time to notice the ticket meter so chanced my luck.

    the ticket says that

    "It is alleged that an offence has been committed involving the use of a mechanically propelled vehicle in a public place"

    on the back it says

    "Registered owner not driving vehicle at time of offence
    5.(1) If you were not driving or otherwise using the vehicle referred to in this notice at the time of the commission of the alleged offence you must as required....... state the name and address of the person who was driving or other wise using the vehicle..."

    Now my question is, going by the alleged offence of "using" the car as stated, how can the car be used if it is unoccupied, locked and unattended??

    could this be challenged??

    I mean thinking on the other side of the coin, that its an offence to be drinking and driving.. could they turn around and give you a ticket for drink driving if your car was parked outside a pub??

    I bet in a court of law that a technicality like that would get you off the hook in 10 million quid narcotic bust. But i bet the book will be thrown at me in fairness

    maybe i set the remote start on the engine, jumped out and then let it creep into the spot by itself before shutting it down.. you watched knight rider?? same thing! :rolleyes: (the judge will understand, ha :p)

    that means anyone who uses a carpark commits and offence.. I mean where does the car be when you go buy a parking disc? You have to park the car before you can buy a ticket. so anyone who wants to use the carpark has to commit an offense before they can legally leave the "parked" car there. no option to pre pay the ticket here..
