My husband is buying a 2nd hand car today. He has travelled to Kildare from cork. He just rang to say the car hasn't been taxed since jan 2013. The person is selling car for a friend who has emigrated. So when change of ownership form comes & we go to tax the car who is liable for the other months with previous owner?

You are only liable for the motor tax for the car from the date of purchase

fill in the change of ownership and photocopy it if you can otherwise the cops could still legally seize the car if its driven back down to cork section 41 of the road traffic act 1994 (as amended) gives them that power, the majority would be understanding but many others wouldnt care, they'd just take the car

    The new owner.

Under the recent review, anyone taxing a vehicle is liable for ALL back taxes. Unless the vehicle has been officially off the road.

Previously one could get a Garda stamp and tax would recommence from the first time you bought it.

As the implementation of these changes are very new yet, the old system may be still accepted.

only from the month the new owner bought the car.

So even though we're only buying it today we'd have to pay 10 months arrears on top of what we will pay to tax the car?

    That's the jist of it.

But I suspect that you'll still get away just renewing the tax from date of purchase, you'll only find out by presenting at the Motor Tax office, the changes are not a month old yet.

    please stop being wrong.

there will be no "getting away with it", that's just how it works.

The new owner only pays motor tax from the beginning of the month that they become the registered owner. This has been the way along time and nothing has changed.

also you dont need to wait for the logbook to come out in your name before you can tax it. just check the "vehicle transaction details" link on the left hand side on www.motortax.ie every day or so after buying the car. it'll tell you when the ownership is changed over. then you can use the "pin retrieval" option on www.motortax.ie to get your pin out by email.

i've done this recently after buying a new car. i had a tax disc (on a car that hadn't been taxed in some time) out in the post before the logbook.

I took my car off the road in May 2012 and was never notified of any changes from Shannon that I needed to declare the car off the road. Just got a seller for the car and I am wondering do I have to back tax the car before I sell or will the new owner be held liable for back taxes. Appreciate any replies.

I assume like above the new owner will only be liable from nov.

No, they're liable from when they buy it, its only an issue for you if you want to tax the car while its under your ownership

Sorry to bring up an old thread, but if selling a car that has not been taxed for a while do I have to pay the old tax? I understand that the new owner will only pay from the month they bought it but do revenue look for the back tax?

  • Registered Users, Registered Users 2 Posts: 51,363 ✭✭✭✭bazz26

    No.

    No.
The government made a bit of a mess of implementing the new system. In the uk, your car must be either taxed or declared off road otherwise you will get a fine in the post automatically. Here, they left it more open. You need to be caught on the road without tax to be fined.
In short, if you sell your car, there is no further comeback re outstanding tax - provided you have not been caught without tax.

Thanks. Don't drive the car at all, it's in a shed in the country. Worth nothing really but just wanted to check if I sell/scrap it if I was basically going to be hit with back taxes.

    Thanks

If you sell it the new owner can , within two weeks, declare it off the road.

NO.you are not liable for any arrears.but you will have to tax it from whatever month you bought it. (or declare it off the road if you are not going to use it)
make SURE you fill in the date of purchase on the log book,do not leave it to the seller to do this. and take a photo of it with your phone.

Here the government completely fooked it up. Honestly how could they be so stupid?

The people that used to tax 3 months on, 3 months off, now do 3 months husband, 3 months off, 3 months wife, 3 months off

And of course still get away with it. How Irish a system.
