A friend of mine recently had a bad experience with a doctor and is saying now he wished he had of secretly audio recorded it, I said this must be illegal and we argued over it. Kind of thought you would have to ask the person before recording conversations? Anyone know how this works?

It's only illegal if someone finds out about it.

Investigative journalists do it all the time.

    Bad diagnosis?

    Miss diagnosis ?

Self diagnosed that the Dr didn't agree with ?

    Abusive Dr ?

Yeh but wasn't there uproar over it recently in the UK? But can't seem to find anything about laws in Ireland. Know I'd be seriously pissed if someone came into my work place and done it

Pretty sure it's not illegal. would it just not be admissible in court or be entrapment ?

Don't think it would serve any purpose if he wasn't happy he could easily lodge a complaint ,

Secret recording wont help him at all

Trick is to film himself, not the doctor.

I remember seeing a case of it a while back while innocently searching the web.

This guy goes into the doctors office and the doctor and a nurse have sex with him. I was shocked.

Investigative journalists do it all the time.

Difference between investigative journalists secretly recording is that if they get brought to court they could argue that the reasons they were secretly recording was in the public interest, generally this will only be done if the journalist is certain that their reason for secretly recording trumps the law, basically. They have to be very very certain of the stroy they're chasing.

It is illegal to record someone without their knowledge, OP. Maybe try to lodge a complaint, but I definitely wouldn't recommend secretly recording.

Legal but inadmissible. Would be admissible if the GP being recorded was informed of it, & consented to it, but then again in that case he'd have the right to immediately terminate the conversation.

Are you sure your friend just wasn't adding stocks to the fap bank?

don't agree with it without consent myself, just wondering what the actual law said on it or if it said anything

You came to After Hours to get a legal opinion?

    I don't think that's a wise course of action.

From a moral perspective it's wrong to record somebody and then use that recording. So I think that the IMO would refuse to hear the tape, and brand your friend as an idiot. It may be difficult to get a doctor who would take you on as a patient afterwards?

In summary then - no, tell "friend" not to do it.

I did but he is adamant that the aw says you can record what you want. I find it hard to swallow this but according to him that's the case. The little I can find online says you can in fact record a conversation once at least one of the people in the convo agree that one person being you but you can't use the recording in court with out having got previous consent by the 2nd party but can't find any actual laws on it, just what people are saying

As a lawyer I can confidently say:

    Law is tricky stuff

Ironic it was originally written down in plain English (and not in Latin) so anyone could defend themselves look at it now
